By reviewing pages on SparFuel's website, you agree to be bound by our Terms & Conditions.

• In the following conditions, the "Cardholder" is defined as the bearer of the card. "The Customer" refers to the company, person, or persons who accept the cards to get fuel.
• The customer should request SparFuel to issue fuel cards after submitting the application form and the required documents for the customer’s nominated vehicles. The customer must always ensure the secure handling of the card and its distribution to their drivers. The customer is also accountable for the confidentiality of each card’s PIN number.

Liability

The customer is responsible for any misuse of the card and PIN code that violates the contract, unless the customer and authorized user have taken all reasonable precautions against such unauthorized use. Specifically, the customer will be considered not to have taken all reasonable precautions if the unauthorized use or misuse of the card was facilitated or enabled through actions contrary to the agreement.
• The card was not stored with care.
• The PIN code was either noted on the card or directly linked or stored with the card in another way.
• The theft or loss report was not promptly forwarded to SparFuel upon discovery.
• The card was handed over to third-party subcontractors in an unauthorized manner.
• After the third party's authorization to use the card expires, no new PIN code can be requested. The customer is responsible for any misuse of the card by individuals to whom it has been entrusted.
• The Card will always remain the property of SparFuel and can be returned upon request. It should not be given to any other party, except for the Customer's employees, without prior written consent from SparFuel.

Card Application

The customer is responsible for ensuring that the information provided on the card application form is accurate. SparFuel's decision to issue or refuse to issue cards is based on credit information obtained from a credit reference agency for insurance purposes.
• The cardholder must carefully guard the card against loss, theft, or damage and promptly report any of these incidents to SparFuel. Failure to make that report makes the Customer liable for all unauthorized transactions.
• The entire outstanding balance on the customer's account must be paid in full to SparFuel. The right to use the card will automatically terminate if the customer (a company) goes into liquidation, has a receiver or administrative receiver appointed, or has an administrator appointed. If the customer is an individual, the right to use the card will terminate if they become bankrupt, or in the event of their death, or if they enter into a formal or informal agreement with their creditors. This termination does not affect the customer's liability for any card use after termination or the rights of SparFuel that have already accrued at the time of termination.
• SparFuel reserves the right to cancel a card upon the Customer’s written request and may ask for the return of the relevant card. Additionally, SparFuel may cancel a card at any time without notice or refuse to issue a new card or replace any card. Termination does not affect the Customer’s liability for the use of SparFuel prior to termination. The cardholder must take reasonable care and precautions to prevent the loss, theft, or damage of any card and must not share the Personal Identification Number of the card with anyone else.
• The customer must not sell any debts to another party or factor any debts to a third party without written consent from SparFuel. Failure to comply will hold the directors of the customer personally responsible for any unpaid debts to SparFuel.
• In case of a lost or stolen card, notify SparFuel immediately. The customer is responsible for unauthorized transactions within 72 hours of the loss/theft.
• No claim by the customer or a cardholder against a supplier can be used as a set-off or counterclaim against SparFuel.
• SparFuel shall not be liable in any way if the card is not honored by a supplier, whether due to non-acceptance, non-delivery of fuel, or otherwise.
• The cards are only valid at specific gas stations. For more information, please contact SparFuel.
• SparFuel may, at its absolute discretion, establish a credit limit for the Customer. If the amount due exceeds, or is likely to exceed, this limit at SparFuel’s absolute discretion, SparFuel reserves the right to suspend the account without further notice.
• SparFuel may change or add to these conditions at any time, and publishing any changes will serve as notice to the customers.

Fees and Payment Terms

• Payment Schedule: Fees for services will be invoiced according to the schedule specified in your service agreement.
• Method of Payment: Payments must be made via the methods specified in your account settings or service agreement.
• Late Fees: Late payments may incur additional fees as outlined in your service agreement.
• Suspension of Services: SparFuel reserve the right to suspend or terminate services in the event of non-payment.
• Taxes and Duties: You are responsible for all applicable taxes, duties, or other governmental charges arising from your use of the Services.
